# JessLoop — Terms of Use (Key User Obligations) These obligations apply to all customers (“**Users**”) of **JessLoop** and its WhatsApp Business Platform services (the “**Platform**”). By using the Platform, you agree to the following: --- ## 1) User Responsibilities (Permitted Use) * Use the Platform **only for lawful purposes** and in accordance with all applicable laws and regulations. * Comply with **Meta/WhatsApp Business** policies at all times, including (without limitation) the WhatsApp Business Terms and Commerce/Business Policies. * **No spam or deceptive practices**: do not engage in fraudulent, misleading, or manipulative messaging, impersonation, phishing, or misrepresentation. * Obtain and **maintain valid opt-in** for each end-user before messaging; send **relevant, expected content** consistent with the opt-in context. * Do not use the Platform to transmit **malware**, harmful code, or content that is abusive, illegal, defamatory, obscene, incites violence, or violates third-party rights. * Agencies/Resellers: you are responsible for ensuring that your **clients and sub-accounts** comply with these obligations. --- ## 2) Account Security * You are responsible for **safeguarding account credentials**, API keys, and access tokens; enable available security controls (e.g., 2FA/MFA). * Notify JessLoop **promptly** of any **unauthorized access** or suspected compromise. * You are responsible for **all activity** that occurs under your account, whether authorized by you or not. * Do not share, resell, or transfer your account access except as expressly permitted in writing by JessLoop. --- ## 3) Payments & Billing * You agree to pay all **plan fees, usage charges, taxes**, and other amounts according to the pricing and billing terms presented at signup or renewal. * JessLoop may **suspend or limit** services for non-payment, payment method failure, chargebacks, or material breach. * Fees are generally **non-refundable** unless otherwise stated in a written order or refund policy. * JessLoop may update pricing or billing terms with **reasonable notice**; continued use after the effective date constitutes acceptance. --- ## 4) Data Protection & Messaging Conduct * For end-user data you upload or process via the Platform, **you are the data controller**; JessLoop processes such data **on your behalf**. * You must: * Obtain **lawful consent/opt-in** from end-users before sending messages; * Provide **clear opt-out** mechanisms and honor opt-out/DND requests; * Comply with applicable **privacy/data protection laws** (e.g., India DPDP Act, GDPR, etc., as relevant); * Only process data that is **adequate, relevant, and limited** to what’s necessary; * Avoid sending **sensitive personal data** (e.g., financial, health, biometric, children’s data) unless strictly necessary and lawful; never store raw payment card data on the Platform. * You are responsible for notifying JessLoop of any **security incident** affecting data you control and for cooperating to address it. * Upon termination or expiry, request deletion/export of end-user data per your legal obligations and our retention practices. --- ## 5) Compliance with Meta/Channel Policies * You must follow **WhatsApp/Meta** terms, template rules, quality ratings, rate limits, and review processes; use only **approved templates** where required. * If Meta/WhatsApp or any channel provider flags your number/account (e.g., poor quality, policy breach), you are responsible for **remediation**. * JessLoop may **suspend, restrict, or terminate** access (in whole or part) to protect platform integrity or comply with provider/legal requirements. --- *Questions about these terms or need a Data Processing Agreement (DPA)?* Email us at **[support@jessloop.com](mailto:support@jessloop.com)**.
